Mr. Sukanta Ghosh, Mr. Arghya Chatterjee .... for the petitioner Mr. Avishek Guha, Ms. Akansha Chopra ... for the respondent Bank The petitioner seeks urgent relief which is essentially in the form of a leave to approach the DRT-3 with reference to a notice of possession and for quashing of all actions taken by the respondent Bank. The reason for asking the Court to intervene is that the DRT-1 and the DRT-3 are not functioning as of present and all the matters have been assigned to DRT, Cuttack.

Learned counsel for the respondent Bank submits that both the DRTs will start functioning from 28th February, 2023.

WPA 1456 of 2023 is accordingly disposed of with leave to the petitioner to move the appropriate DRT by 3rd March, 2023. The respondent Bank shall not take any steps against the petitioner till 3rd March, 2023. It is made clear that this Court has not gone into the merits of the dispute.
