(DB) No. 272 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Domkal Police Station Case No. 414 of 2021 dated 15.07.2021 under Sections 302/34 of the Indian Penal Code and under Sections 25/27 of the Arms Act.

And In Re : Piarul Mondal @ Piarul Mondal ..... petitioner Mr. Raju Mondal ... for the petitioner Ms. Zareen N. Khan Mr. Asif Dewan ... for the State Learned Counsel for the petitioner submits he renews his prayer for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Statements of the witnesses show that the petitioner and others fired at the victim. As a result he died. Under such circumstances and in view of gravity of the offence and prima facie involvement of the petitioner in the murder, we are not inclined to grant bail to him.

The application for bail is, thus, rejected.
