Suhail Ms. Paramita Mondal Mr. Suman Halder ...for the Petitioner This application has been preferred by the petitioner with a prayer for a direction upon the court below for expeditious disposal of G.R. case no. 1644 of 2024, presently pending before the learned Additional Chief Judicial Magistrate, Raiganj.

It is submitted on behalf of the petitioner that the complaint was lodged on 26.7.2024 and the charge-sheet was submitted against the opposite party no. 2 on 17.11.2024. Learned court below took cognizance of offence on 30.12.2024 and thereafter copy of prosecution documents was also served upon the accused person but the case has not proceeded further and the next date is fixed on 18th May, 2026. Having heard learned counsel for the petitioner and on perusal of the order dated 9th February, 2026, it appears that the sole accused is absconding and for which, the court below had issued warrant of arrest and the next date is fixed for execution report and for which, the charge hearing could not be conducted by the court below.

Since the prayer made by the petitioner is innocuous and if the prayer for expeditious hearing of the proceeding is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice, the service of copy of application upon the opposite party is dispensed with. Having considered the facts and circumstances of the case, the instant application being CRR 299 of 2026 is hereby disposed of with a direction upon the court below to expedite the next process to be adopted by the court below in respect of the absconding accused if he remained absent and/or to take any coercive step in order to compel his attendance before the court below for charge hearing at the earliest. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
