On 05.02.2024 when the revisional application was taken up, none appeared on behalf of the petitioner. Today the revisional application was again called. Learned advocate appears for the petitioner.

I have checked the enclosures to the revisional application which include only FIR, letter of complaint and report under Section 173 of the Code of Criminal Procedure. The stage of the case before the learned trial court is also not reflected in the enclosures. Having considered that the subject-matter of the case relates to a proceeding in connection with Sagarpara Police Station Case No. 169 dated 19.06.2023 wherein only charge-sheet has been submitted and documents under Section 207 of the Code of Criminal Procedure are not available, I grant liberty to the petitioner to canvass all the issues at the time of consideration of charges before the learned trial court after receipt of the documents under Section 207 of the Code of Criminal Procedure. Needless to state that the learned trial court would consider the issue of discharge without being influenced by any observations made by this Court while disposing of the present revisional application.

With the aforesaid observations, the revisional application being CRR 294 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
