Apprehending arrest in connection with Raghunanthganj Police Station Case No.102 of 2020 dated 14.01.2020 under Sections 489B/489C of the Indian Penal Code, the petitioner has filed the instant application for anticipatory bail. Ms. Gomes, learned Advocate appearing for the petitioner submits that the petitioner has been implicated in the instant case on the basis of statement of the accused from whom seizure has been effected. Learned Advocate submits that there was no seizure from the possession of the present petitioner and as such, he may be granted the relief as prayed for. Learned Advocate appearing for the State opposes the prayer for anticipatory bail and draws attention of this Court to the statement of the witnesses as also the seizure lists.
We have perused the case diary and we find that in the present case fake currency was recovered from the principal accused while he was in custody in connection with another case and produced before the Jangipur Court. It was the Court Inspector who intercepted and thereafter the fake currency was recovered. Materials in the case diary shows that the present petitioner had met with the principal accused from whom seizure has been effected.
Having regard to the nature and gravity of the present offence, we are not inclined to extend the privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
