Mr. Sarban Bhattacharjee ......for Applicant This contempt application is filed alleging violation of the order of injunction granted by the learned District Judge, Alipore, South 24 Parganas in Misc. Case (Arbitration) Case No.9 of 2022 dated 16.02.2022. Admittedly, the applicant has effective remedy under Order 39 Rule 2A of the Civil Procedure Code and without exhausting that we are not inclined to entertain this application as several factual issues are involved in this matter. Therefore, the contempt application is disposed of by granting liberty to the applicant to move before the learned District Judge, South 24 Parganas by filing an application under Order 39 Rule 2A of the Civil Procedure Code. If already such an application is filed the learned Court below is directed to take into consideration the said application and after hearing dispose of the same as expeditiously as possible preferably within a period of six weeks from the date of receipt of this application.
