The petitioner prays for expeditious disposal of Matrimonial Suit No.78 of 2009 under Section 13(1)(ia) of the Hindu Marriage Act, 1955, which is pending before the learned District Judge, Alipore. It is submitted that the wife is a service holder and has not prayed for any maintenance pendente lite. The petitioner relies on an earlier order of a Coordinate Bench directing expeditious disposal of the suit.

The prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite party.

This revisional application is disposed of by requesting the learned Trial Judge to dispose of the said matrimonial suit upon taking note of the fact that the suit is pending since 2009 and the age of the parties. This Court is of the view that

justice would be subserved if the suit is disposed of within six months.

This court has not expressed any opinion on the merits of the suit. The learned court shall proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite party and/or the learned advocate contesting the matter on behalf of the opposite party in the learned court below, within a week. 6.

Affidavit-of-service to be filed before the Court below.

The revisional application is accordingly disposed of. There shall be no order as to costs.
