Mr. Debapratim Guha Mr. Diptendu Banerjee Ms. Anchita Sarkar .....For the Petitioners Petitioners have challenged the continuance of Kalna Police Station Case No.962 of 2023 dated 29.08.2023 under Sections 448/ 323/ 354/ 379/ 506/ 34 of the Indian Penal Code, which are presently pending before the learned Additional Chief Judicial Magistrate, Kalna, Burdwan.

Learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated and in a designed manner, all of them have been dragged into the case.

I have considered the allegations and prima facie for registration of the F.I.R., the ingredients are satisfied. However, it is the investigation, which would reveal regarding the truth or falsity of the allegations made therein. Having considered the fact that the investigation of the case is still in progress on the issue of factual aspect, I do not intend to interfere. However, if there are other issues, which the petitioners intend to canvass, which are in their position, they would be at liberty to approach physically with a written representation before the D.S.P./Additional S.P./ S.D.P.O., who is in charge of Kalna Police Station.

With the aforesaid observations, C.R.R. 306 of 2024 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
