Begg ... ... for the State Petitioner is directed to serve a copy of the revisional application upon the Mr. Pravash Bhattacharyya, who ordinarily appears on behalf of the State. His appointment be regularized by the concerned authorities.

Learned advocate appearing for the accused petitioner submits that the Sessions Trial commenced in the year 2015 before the learned Additional District and Sessions Judge, 16th Court, Alipore and out of the 11 witnesses so cited by the prosecution till date only two witnesses have been examined. Petitioner is facing unnecessary harassment since the case was initiated in the year 2012. It has also been informed that the next date has been fixed on 5th September, 2023.

Having regard to the fact that the case commenced almost 11 years ago, I direct that the learned trial Court henceforth from 5th September, 2023 shall fix schedule of three dates on and each and every month. Such schedule should be fixed for examination of the witnesses. If any of the witness is not present, learned trial Court would take aid of the ACP/DCP/In-charge of Gariahat Police Station and take steps for ensuring appearance of the witnesses concerned.

It is further directed that no unnecessary adjournment should be granted to either of the parties.

Public Prosecutor conducting the case would ensure for production of the materials/exhibited documents on the dates fixed for examination of the witnesses. All the stakeholders would take efforts and co-operate, so that the trial of the case is taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 208 of 2023 is disposed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
