Nag Mr.Subhankar Das ..for the BMC Let the affidavit of service be taken on record. The petitioner is before this Court alleging inaction on the part of the Bidhannagar Municipal Corporation. It is the contention of the petitioner that the petitioner's representation dated September 29, 2020 addressed to the Commissioner, Bidhannagar Municipal Corporation has not been disposed of. The petitioner seeks permission to complete his dwelling house by raising certain construction. Such structures are already a part of the plan earlier sanctioned by the Corporation.

It is submitted by the learned advocate for the petitioner that the father of the petitioner who was granted the sanctioned building plan could not complete the construction and thereafter the plan expired. The father of the petitioner also expired.

Mr. Das, learned advocate for the Corporation submits that there is a procedure to apply for renewal of the sanction plan in accordance with the rules and the petitioner has not approached the authority as per rules.

Having considered the rival contentions of the parties, this writ petition is disposed of granting liberty to the petitioner to apply in the appropriate form before the Corporation for renewal of the sanction plan which has expired and comply with all formalities. The corporation shall consider the said application and dispose of the same in accordance with law urgently, preferably within a period of two months from the date of receipt of the application and compliance of all formalities by the petitioner.

This writ petition is disposed of.

There will be however no order as to costs.
