The petitioner prays for consideration of the representation submitted by him before the concerned Authority on 10th January, 2022.

It is contended on behalf of the petitioner that it is necessary to construct culvert adjoining the petitioner's land and the approach road for the purpose of egress and ingress of the petitioner. The petitioner has also alleged that the private respondents are trying to raise illegal construction by encroaching upon a portion of the Government land, thereby obstructing the egress and ingress of the petitioner. The petitioner submitted a representation before the concerned Authority in this regard on 10th January, 2022 which is yet to be disposed of. The petitioner prays for a direction

upon the Authority to consider the representation at the earliest.

It is submitted on behalf of the State respondents that the representation submitted by the petitioner may be directed to be disposed of by the concerned Authority. Learned counsel further submits that as per police report received by him no encroachment was found on Government land as alleged.

In view of the same, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the representation submitted by the petitioner dated 10th January, 2022 within two months from the date of communication of this order after giving reasonable opportunity of hearing to the petitioner and the private respondents, in accordance with law.

The decision taken by the Authority shall communicated to the petitioner within a week thereof. W.P.A. 1374 of 2022 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
