Report, memo of evidence as well as photocopies of documents supplied to the petitioner under Section 207 of the Code of Criminal Procedure submitted by the State are taken on record.

The petitioner is in custody for more than 7 months. Learned counsel for the petitioner submits that the petitioner is not the principal accused. There are about 42 witnesses to be examined and completion of trial in near future is bleak. Further detention of the petitioner is not required.

Opposing the prayer learned counsel for the State submits that the petitioner is the mastermind of the alleged offence and the layout for the offence as well as part of the

booty were recovered pursuant to statement made by the petitioner. Also, the petitioner has criminal antecedent. In view of the material available in the case diary, this Court is inclined to hold that it is not a fit case where the petitioner can be released on bail at this stage. Accordingly, the prayer for bail is rejected at this stage.

The application for bail, being CRM (DB) 335 of 2025, is, thus, disposed of.
