Mr. Habibur Rahaman Mr. Suvro Prasad Lahiri Mr. Sadik Ali Dhali .....For the Petitioner Mr. Biswanath Chatterjee Mr. Sobham Kumar Pathak ...for the Private respondent Petitioner applied for LPG distributorship license under the respondent no. 3 i.e. Indian Oil Corporation Limited. He made one online application on 28.01.2024 for the LPG distributor.
It is the case of the petitioner that he was selected in the draw of lots in respect of the said vacancy on 23rd October, 2024. Since then she had approached several times before the office of the concerned authority but no correspondence has been made in her favour. Accordingly she made a representation to the Deputy General Manager, HPCL on 17th December, 2024. Her representation was not answered. Hence this writ.
During the course of hearing of this matter
Mr. Chatterjee, learned counsel for the respondent no. 3, submits that the petitioner was selected in the draw of lots on 23rd October, 2024. On the next day the respondent no. 3 has issued a detailed mail in favour of the petitioner to his registered e.mail address. He places the copy of the mail. Mr. Chatterjee further submits that it has specifically noted in the mail that "please note that your candidature is liable to be cancelled in case you fail to deposit the above amount and documents listed above within 7 working days from the date of this intimation." Mr. Chatterjee further submits that the respondent no. 3 had issued series of mail in the registered e.mail address of the petitioner regarding receiving of application and details of draw of lots etc. but petitioner has not responded.
He places the database of the copy of the mail. It appears firstly on 28th January, 2024 one mail was sent to the e.mail address to the petitioner i.e. "rabindranath paul 67 @ gmail. Com. containing that "Dear Jhuma Ghosh thank you for submit form your application reference number is ......."
attachment for draw intimation latter with reference to your application no......". On 24th of October, 2024 another mail was sent containing inter alia that "hello Jhuma Ghosh please find the attachment of security deposit letter with reference application no. ...".On 4th November, 2024 a reminder mail was issued on the same registered mail address of the petitioner containing inter alia that "hello Jhuma Ghosh it is reminder for deposit security deposit for conduct of the (FVC) for selection of LPG distributorship at Dakshin Akharbala for application reference no....."
Considering the entire aspect it appears to me that the present petitioner was selected in the draw of lots and she was intimated to comply with the formalities but the petitioner had never taken any step or responded any communications. At this juncture, I find no material to entertain the petitioner. The petitioner has given her e.mail address in the application itself wherein the respondent authority has conducted. On that score, I find no arbitrariness of the respondent authority.
Hence, writ petitioner is devoid of merit.
Thus, The same is dismissed and disposed
of.
