1. Appellants are represented by the learned Advocate.

3. In pursuance of the direction passed by this Court a report is submitted by the Superintendent, Midnapur Central Correctional Home which is handed over by the learned Advocate for the State during course of hearing. The said report indicates that both the appellants/convicts namely, Gobordhan Jana and Gopal Mahapatra had served out the substantive sentence as passed by the learned Trial Court in the judgment and order of conviction and they were released on 12.09.2011. The report submitted by the Superintendent, Midnapur Central Correctional Home be taken on record.

4. As the appellants/convicts have already served out the sentence, the instant appeal is hereby dismissed affirming the impugned judgment and order of conviction passed by the learned Trial Court dated 21.12.2005 and 22.12.2005

passed in connection with Sessions Trial Case No. XXVIII/May/2000 arising out of G.R. Case No. 446/96.

5. Thus the instant appeal be and same is hereby disposed of.

6. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
