The instant appeal has been preferred against judgment and order being order No. 9 dated 17.11.2005 passed in Criminal Appeal No. 22 of 2005 passed by the learned Additional Sessions Judge, 1st Fast Track Court, Hooghly in reversing the order dated 31.01.2005 passed by the learned Judicial Magistrate, 2nd Court, Chandannagore, Hooghly in T.R No. 13 of 1999 filed under Section 498A and 406 of the Indian Penal Code.

The learned advocate for the appellant has filed a written instruction that his client does not wish to proceed with the instant appeal. A written instruction dated 16.10.2023 submitted before the court to that effect be kept on record.

Under the facts and circumstances, the instant appeal is dismissed for non-prosecution.

Copy of the order and lower court records be sent to the trial court for due compliance.
