The petitioners allege that respondent no. 9 undertook unauthorized construction on the concerned land in the year without obtaining permission from the Panchayat Authority. The petitioners accordingly pray for demolition of the said construction.

From the report filed by the Block Development Officer, Joynagar-I, District South 24 Parganas, it appears that a spot inspection was conducted by the concerned Gram Panchayat. Upon inspection, it was found that no new construction was being carried out on the relevant plot, being L.R. Dag No. 757, J.L. No. 5, under Mouza Sarberia. The inspection report further reveals that the existing structure on the said plot had been constructed many years ago. The allegation of the petitioners that the construction was raised in the year 2021 has, therefore,

been found to be baseless.

In any event, this writ petition has been filed in the year 2025, and in view of the belated approach of the petitioners, coupled with the findings contained in the report of the Block Development Officer, I am not inclined to entertain this writ petition.

Accordingly, WPA 1625 of 2025 stands dismissed. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
