The State of West Bengal & Ors.

Mr. N.I.Khan Mr. Amlan Kumar Mukherjee ..for the petitioner Mr. Pantu Deb Roy Mr. Subrata Guha Biswas ....for the State Affidavit of service filed in Court is taken on record. The petitioner's father was granted stage carriage permit in the route Howrah Fire Service Station to Esplanade which was valid till February 17, 2012. The petitioner's father expired on December 22, 2008 and the permit was not renewed. The petitioner has applied for issuance of fresh permit in his favour on May 08, 2017 which was received by the authority on May 11, 2017 along with requisite fees. The application is yet to be considered. The petitioner prays for direction upon the authority to consider the application at the earliest. Learned counsel for the respondents submits that the 2nd respondent be directed to consider the application in accordance with law.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the said application submitted by the petitioner on May 08, 2017 within a period of six weeks from the date of communication of this order upon affording reasonable

opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
