The petitioners say that they have been falsely implicated. They have no role to play in the alleged incident of cheating. They are in custody for 124 days. Investigation is complete and charge sheet has been submitted. Therefore, their further custodial detention is unnecessary.

Opposing the bail prayer, learned State Advocate shows us the material in the case diary. He says that the petitioners are habitual offenders. They have another criminal case pending against them. They have defrauded the defacto complainant of this case by extracting money from him against promise to secure a job for him. These kind of economic crimes should be strongly discouraged.

We see that charge is yet to be framed. Charge sheet was filed only on December 31, 2024.

We also see that the petitioners are residents of Ahamedabad, Gujarat. There is possibility of the petitioners absconding if enlarged on bail even before charge is framed. In that case, the framing of charge will be jeopardized and the trial as a whole will be stalled.

On an overall assessment of the material on record, inter alia, since charge is yet to be framed, we are not inclined to enlarge the petitioners on bail.

CRM (DB) 309 of 2025 is, thus, dismissed.
