Mr. Moyukh Mukherjee .....For the Petitioners Petitioners are aggrieved by the factum of a charge-sheet being filed after further investigation.

Learned advocate appearing for the petitioners and submits that a civil suit is pending between the parties for a considerable period of time and the complainant being a sister is aggrieved by the factum that she has not received the mother's property, which was bequeathed in favour of the late father of the present petitioner no.1. I find that the petitioners approached this Court at a stage when the Investigating Agency has submitted their report under Section 173 but the documents under Section 207 of the Code of Criminal Procedure are yet to be supplied.

Petitioners would be at liberty to canvass all the points in the present revisional application by way of taking out an application under Section 239 of the Code of Criminal Procedure, if so advised. Learned Magistrate would dispose of such application independently without being influenced by any observations made by this Court.

Learned Magistrate would also take efforts so that on the next date if the petitioners are present, copies under Section 207 of the Code of Criminal Procedure may be handed over to them. With the aforesaid observations, C.R.R. 303 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
