Petitioners are aggrieved by the fact that the private respondents are encroaching the land of the petitioners and raising construction without any authority and in case the petitioners inform the appropriate authorities they are being implicated in a false case. Petitioners lastly represented to the police authorities on or about 19.12.2024. However, till date no action has been taken. Learned advocate for the petitioners submits that the petitioners are unable to construct the drainage because of the obstruction created by the private respondents.

State has submitted a report prepared by the Officer-in-Charge, Hirapur Police Station wherein the

police authorities have denied the accusations made in the writ petition.

Be that as it may, petitioners are granted liberty to approach the municipal authorities for their appropriate relief. In case the municipal authorities pass appropriate orders, police authorities would render appropriate assistance to the petitioners. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident because of the inimical relationship existing between the petitioners and the private respondents.

With the aforesaid observations, WPA 1589 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
