The learned Advocate for the petitioner submits that the petitioner has been implicated in this case pursuant to the seizure made in respect of Rs.1,62,45,200/- along with some articles. The learned Advocate further submits that there are no allegations of cheating or receiving of any theft articles but on the basis of suo motu cognizance the present case was registered.

Mr. Sur, learned Advocate appearing for the State draws the attention of the Court to the seizure list as also certain investigation being carried out in respect of the laptop which has been seized.

We have perused the case diary and we find that the investigation is at the nascent stage and communications have been made to the concerned authorities for verifying the authenticity. We further find that the information has also sent to the Income Tax Department to take appropriate action. In view of the steps taken by the investigating agency till date and the materials which have been surfaced in the investigation, prima facie we are of the opinion that custodial detention of the petitioner at this stage is unwarranted. The

prayer for anticipatory bail is allowed.

Accordingly, in the event of arrest, the petitioner will be enlarged on bail on furnishing security bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. The petitioner shall meet the investigating officer of the case twice a week on and from 12th April, 2021 until further orders. The petitioner shall deposit his passport (if any) with the investigating officer of the case and the same may be released after obtaining permission from the jurisdictional Magistrate. In the event the petitioner does not possess the passport, an affidavit to that extent should be filed before the investigating officer.

The prayer for anticipatory bail is allowed.

CRM 690 of 2021 is, thus, disposed of.
