Versus

The State of West Bengal & Ors.

Mr. Jagabandhu Ray Mr. J. Haque ..for the petitioner Mr. Pantu Deb Roy Mr. Subrata Guha Biswas ....for the State Affidavit of service filed in Court is taken on record. On the prayer of the petitioner liberty is granted to implead the Regional Transport Authority, Kolkata Region as respondent no. 4 in the writ petition.

The cause title of the writ petition be amended accordingly.

The petitioner applied for route permit in respect of the route S-123 (Metiaburz to Howrah Station) on November 12, 2020 and was directed to appear before the authority along with relevant documents for a hearing. Though the petitioner appeared before the authority and deposited the requisite fees, no further communication has been made to him till date. The petitioner prays for a direction upon the authority to communicate the decision taken by it at the earliest.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since it is not understood as to whether any decision has been taken by the authority pursuant to the hearing, the

concerned authority being the 4th respondent herein is directed to communicate the decision, if any, taken by the authority to the petitioner within two weeks from the date of communication of this order.

In the event no decision is taken by the authority till date, the 4th respondent be directed to take a decision in this regard and communicate the same to the petitioner within four weeks from the date of communication of this order.

With the above observations and directions this writ petition is disposed of.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
