Learned advocate appearing for the petitioner is aggrieved by the fact that, in connection with complaint case being No.AC 968 of 2020, the case has not progressed and till date the stage of Section 251 of the Code of Criminal Procedure is not over. It has been informed that on 05.02.2024, date has been fixed by the learned Judicial Magistrate, 9th Court, Alipore. If the examination under Section 251 of Cr.P.C. has not been complied, on 5th February, 2024, learned Magistrate is directed to overcome the said stage on the next date so fixed. Thereafter, if the petitioner applies under Section 143 A of the Negotiable Instruments Act, learned Magistrate would dispose of the same within a period of 15 days and proceed with the trial of the case by fixing at least one date in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 311 of 2024 is disposed of.

Pending connected application, if any, is consequently

disposed of.
