Mr. Mit Guha Roy Mr. Amit Halder .....For the Petitioner Petitioner prays for expeditious disposal of AC Case No.967 of 2020, which is presently pending before the learned Judicial Magistrate, 9th Court, Alipore.

Grievance of the petitioner is that the petitioner is the complainant, who initiated the instant case in the year 2020 and till date, the examination under Section 251 of the Code of Criminal Procedure is not over. Learned Magistrate submits that because of several issues including the accused persons evading the process of law and resolution of the Bar, the proceedings have not progressed for commencing the trial. The next date has been fixed on 5th February, 2024 by the learned Judicial Magistrate, 9th Court at Alipore. In case the examination of the accused under Section 251 of the Code of Criminal Procedure is not over, the learned Magistrate would on the next date so fixed overcome the stage of Section 251 of the Code of Criminal Procedure. If an application under Section 143A of N.I. Act is filed, thereafter the learned Magistrate would dispose of the same within a period of 15 days. Having regard to the time, which has already lapsed, I direct the learned Trial Court to fix at least one date in

every 60 days so that the trial of the case can be taken to its conclusion within a reasonable period of time.

With the above observation, C.R.R. 309 of 2024 stands disposed of. Pending application, if any, is consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
