The grievance of the petitioner is that the Howrah Municipal Corporation without taking steps to consider the same is simply sitting tight over the matter for a considerable period of time.
The learned advocate for the Howrah Municipal Corporation submits that necessary direction may be passed for consideration of the plan that has been submitted by the petitioner.
Upon hearing the submissions made on behalf of the parties it appears that the petitioner submitted an application for sanction of building plan way back in
November, 2019.
The Howrah Municipal Corporation ought to have taken a decision with regard to the same and communicated the petitioner as to whether the plan will be sanctioned or not. The Howrah Municipal Corporation without taking a decision in the matter simply sat tight over the same for no plausible reason.
In view of the above, the instant writ petition is disposed of by directing the Howrah Municipal Corporation to take necessary steps for consideration of the building plan submitted by the petitioner, strictly in accordance with law, at the earliest, but positively within a period of ninety days from the date of communication of a copy of this order. In the event, the plan of the petitioner is not sanctioned the reasons for not sanctioning the same shall be immediately communicated to the petitioner. The writ petition WPA 821 of 2020 along with CAN 1 of 2020 and CAN 2 of 2020 stands disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
