Learned advocate on behalf of the petitioner submits that the instant criminal application has been preferred for quashing a notice issued against the present petitioner under Section 41A of the Code of Criminal Procedure in connection with Baruipur Police Station case No. 2047 /17 dated 21.7.2017 under Section 363/365 of the Indian Penal Code along with Sections 364/302/201/120B of the Indian Penal Code.
He further submits that the trial of the instant case has already been initiated. Thus, further proceeding of the present criminal revisional application is not necessary. Heard the learned advocate perused the petition also perused the certified copy annexed with this petition. The instant criminal proceeding has already been set on motion. Thus, the notice issued under Section 41A and challenged thereof become infructuous. Hence the instant criminal revisional application is disposed of as infructuous.
