Ms. Koyeli Bhattacharya, learned advocate representing West Bengal Board of Secondary Education submits that report in the form of affidavit is ready but till date the same has not been affirmed. The copy of the said report is placed before this Court and the same is perused.

On perusal of the report as well as the order passed by the Hon'ble Division Bench dated 9th August, 2023 it appears that the Hon'ble Division Bench has observed in paragraph 9 of the said order that the order

passed by the learned single Judge stands modified to the extent as indicated in the said order of the Hon'ble Division Bench. In view of modification of the order passed by the learned single Judge which was under challenge on presenting two separate appeals one being MAT 819 of 2022 and another being MAT 835 of 2022 no further order need be passed on this writ petition. If the parties have any grievance centering around the final order passed by the Hon'ble Division Bench dated 9th August, 2023 whereby the aforesaid two appeals were disposed of that should be brought to the notice of the Hon'ble Division Bench not before this Court. Accordingly, the writ petition stands disposed of. Leave is granted to the Secretary of the Board to affirm the affidavit by 16th July, 2024 and file the same in Court for keeping the same on record. Till such report in the form of affidavit is filed on affirmation in Court a copy of the said affidavit of the Board be kept with the record.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
