(VIA VIDEO CONFERENCE) Mr. Arindam Das Mr. Biswajit Sarkar ...for the Petitioner Mr. Chandi Charan De Mr. Anirban Sarkar ...for the State The petitioner prays for compensation in respect of an alleged illegal acquisition of a 24 decimal plot of land belonging to the petitioner.
Mr. Chandi Charan De, Advocate appearing on behalf of the State-respondents files his instructions which are taken on record.
Mr. De, Advocate further submits that an Advocate of the Suri Judge Court had filed a Power of Attorney on behalf of two of his clients being the legal owners and both are simultaneously claiming compensation relating to the plots of land in question. It is further alleged by Mr. De that neither Somnath Ghosh nor Chandrachur Mukhopadhyay have any right, title or interest to claim any compensation in respect of the subject acquisition proceedings.
Significantly neither Somnath Ghosh nor Chandrachur Mukhopadhyay are in possession of any portion of the subject premises.
In view of the submissions made on behalf of the State, I am unable to be satisfied that the petitioners have any right, title or interest in any portion of the subject premises.
In view of the aforesaid, I find no merit in this petition.
Hence, WPA No. 833 of 2020 is dismissed.
There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
