APP Ms. Snigdha Saha ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for 175 days and he has been implicated on the basis of statement of a co-accused. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that there are call data records. However, the said evidence do not appear in the charge-sheet which has already been submitted. On an assessment of the case diary, I find that the subject-matter of the case is for recovery of 23.658 kg of ganja from a co-accused and the petitioner has been implicated on the basis of statement of a co-accused. Having considered the period of detention of the present petitioner, I am of the view that further incarceration of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Susanta Barman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Additional District and Sessions Judge, 1st Court, Special Judge (NDPS Act), Brrackpore, North 24 Paranas.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special court and shall not leave the jurisdiction of the district of North 24 Parganas without prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 164 of 2026 is allowed. Pending application(s), if any, is also disposed of. Report submitted by the State be kept with the record.
