Report of service of administrative notice upon the parties is received. It appears that from the report that the appellant of the instant appeal namely, Jahar Soren has died. Some of the respondents have also died as reported by the concernd Gram Panchayat.

Learned advocate appeared today on behalf of he opposite party no.5 namely, Matal Soren, opposite party no.8 namely, Bhota Soren, opposite party no.9 namely, Jala Soren. This is an appeal against the acquittal filed under Section 378(4) of the Code of Criminal Procedure. As it is reported that the sole appellant Jala Soren has died. So, it is necessary not to proceed further. This appeal has become infructuous as abated.

Accordingly, the instant appeal be disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
