Mr. Ranadeb Sengupta ... for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Baduria P.S. Case No. 95 of 2020 dated 29.02.2020 under Sections 21(c) of the Narcotic Drugs and Psychotropic Substances Act.

Heard learned Advocates appearing for the respective parties and considered the materials in the case diary. It appears that contraband substance above commercial quantity was recovered from the possession of the petitioner and as such, the statutory restrictions are attracted. In view thereof, the petitioner's prayer for bail is refused at this stage. Answering to our query, Mr. Sengupta, learned Advocate appearing for the State submits that supplementary charge sheet including F.S.L. report has also been submitted and charges have also been framed. Since the petitioner is in custody for more than 2 years, we request the learned Court below to expeditiously conduct the trial and if necessary upon resorting to the steps available under

Section 309 of the Code so that logical conclusion of the case may be reached at the earliest.
