The appeal arising out of order dated 05.06.2014 in connection with an application under Order 9 Rule 13 of the Code of Civil Procedure. We have gone through the order. Moreover, it appears that during evidence the applicant had admitted that he had received notice and the summons. In spite thereof he did not participate in the proceeding.

In view thereof we do not find any reason the interfere in the order passed on 5th June, 2014. The appeal is dismissed.

No order as to costs.
