Mr. Tarak Nath Halder ..for the petitioners This revisional application has been filed for expeditious disposal of the application for temporary injunction filed in connection with Title Suit No. 205 of 2013, pending before the learned Civil Judge, Senior Division, First Court, Barasat, District North 24 Parganas. The petitioners are the plaintiffs in the partition suit and pray that the learned Court below be directed to dispose of the application for temporary injunction. It is also submitted that the written objection to the application for the temporary injunction has already been filed and the same is on record.

Under such circumstances, this revisional application is disposed of with a direction upon the learned Court below to dispose of the application for temporary injunction filed in connection with the said suit by allowing all the parties to contest the same within a period of two months from the next date fixed.

Once the application for temporary injunction is

disposed of, the learned Court below will conclude the hearing and dispose of the same expeditiously preferably within a period of one year thereafter.

This Court has not made any observations with regard to the merits of the case and the learned Court below shall deal with the suit independently without being influenced by any observations made hereinabove. The petitioners are directed to serve copies of the revisional application along with a server copy of this order upon the opposite parties within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
