12-03-2025 (ct. no. 29) KOLE CRM (DB) 321 of 2025 In re: An application for bail under Section 439 of the Code of Criminal Procedure/Section 483 of the BNSS in connection with Kaliganj Police Station Case No. 708 of 2023 dated 04.10.2023 under Section 302 of the IPC.
- A n d - In the matter of : Srikanta Bairagya .... Petitioner.
Mr. Sumanta Chakraborty, ... For the Petitioner.
Mr. Ranabir Roy Chowdhury, Mr. S. Nandy, ... for the State.
Dictated by Arijit Banerjee, J:- 1.
The petitioner says that he has been falsely implicated. The victim was his wife. He had no reason to kill his wife. In fact, his father-in-law inflicted grievous injury on him when he was residing in his father-in-laws' house. He is in custody for one year five months. He also suffers from various ailments. He prays for bail.
2.
Learned State Advocate tells us that 16 out of 27 charge sheet named witnesses have already been examined. They include eye-witnesses. The witnesses have clearly implicated this petitioner who is alleged to have murdered his wife with 'hasua'. 3.
In view of the prima facie incriminating material against the petitioner and the gravity and nature of the offence and keeping in mind that if convicted, he will have to suffer mandatory life imprisonment and also seeing that the trial is progressing at a highly satisfactory pace, we are not inclined to enlarge the petitioner on bail, at this stage.
4.
CRM (DB) 321 of 2025 is, thus, dismissed.
5.
However, we direct the Superintendent of Krishnagar District Correctional Home, Nadia, where the petitioner is lodged, to arrange for all necessary medical attention that the petitioner may require. If it is found that the hospital attached to that correctional home is not equipped to treat the petitioner, other arrangements shall be made so that the petitioner does not suffer for lack of medical treatment.
6.
Further, considering the petitioner's period of detention, we direct the learned Trial Court to expedite the trial to the extent possible and conclude the same on an early date without granting unnecessary adjournments to either of the parties, if necessary, by fixing schedules for 2/3 days each for examination of witnesses. 7.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Om Narayan Rai, J. ) ( Arijit Banerjee, J. )
