Learned Counsel appearing for the petitioner submits that after ventilating its grievances before the University of Burdwan, the Registrar, University of Burdwan has made a representation dated 25th April, 2017 before the learned Secretary, Higher Education Department, Government of West Bengal but that representation made by the University of Burdwan has not been considered till date.

Mr. Bihani, learned Counsel appearing for the University and Mr. Datta, learned Counsel appearing for the State are present.

Heard all the parties.

As the representation dated 25th April, 2017 is still pending, I request the learned Secretary, Higher Education Department, Government of West Bengal being the respondent no.1 to consider the representation of the petitioner dated 25th April, 2017 at page 45 of the writ petition and pass a reasoned order, as early as possible, preferably within a period of twelve weeks from

date after giving an opportunity of hearing not only to the petitioner but also to the respondent authorities to produce necessary documents at the time of hearing. The learned Secretary, Higher Education Department, Government of West Bengal is also requested to communicate such decision at an earliest.

Learned Advocate-on-record of the petitioner is also requested to serve a copy of this writ petition to the learned Secretary, Higher Education Department, Government of West Bengal along with the order of this Court positively within 7 days from today.

The writ petition being WPA 1833 of 2021 is accordingly disposed of.

I make it clear that I have not gone into the merits of the writ petition, all the issues are left open to the learned Secretary, Higher Education Department, Government of West Bengal to be decided by him. There will be no order as to costs.

Since no affidavit have been invited, the allegations made in the writ petition are deemed to have been denied.

Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
