Attention of this Court has also been drawn to the order dated 9th October, 2020 passed by the Sub-Divisional Magistrate, Bishnupur, Bankura wherefrom it appears that added respondents did Rule drawn on separate sheet.
not have the requisite permission to make construction. In spite of clear finding made by the Sub-Divisional Magistrate in the order dated 9th October, 2020 no proceeding has been initiated in terms of Section 23(6) of the West Bengal Panchayat Act, 1973 which by this time ought to have been initiated.
Let contempt Rule be issued against the alleged contemnor No.2 and the Rule is made returnable on 1st March, 2024.
The learned advocate for the applicant is
directed to put in Special Messenger Cost by 6th February, 2024 for expeditious service of the Rule upon the alleged contemnor No.2.
However, pendency of this contempt application shall not preclude the alleged contemnor to comply with the order passed by the Court on 11th February, 2020.
