...For the State Petitioner alleged that he was threatened by the private respondents along with certain civic volunteers and the police authorities. Accordingly, information was sent to the senior officers but no action has been taken by the Superintendent of Police, Murshidabad.

Learned advocate for the private respondent submits that he has handed over goods worth Rs.49 lakhs. Cheque was issued to that effect and consequently the present complaint has been lodged for the purposes of preventing the respondent No.6 from his rightful claim.

Learned advocate for the State has submitted a report. The report reflects that a cheque which was issued by the present petitioner's son drawn on Bandhan Bank, Mallickpur Branch.

Be that as it may, prima facie, it reflects that the present case has been initiated for circumventing the issue relating to any proceeding arising from the dishonor of the cheque as in the last paragraph of the information furnished to the superior officers. An apprehension is expressed by the petitioner that there is a probability of implicating him in a false case.

Be that as it may, police authority will only restrict to the effect that there is no physical assault being inflicted at the behest of either of the parties.

With the aforesaid observations, WPA/1469/2024 is disposed of.

Report, so submitted, is kept with the record. Copy of the report be handed over to both the parties.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.
