It is submitted on behalf of the petitioner that Section 173(8) of the Code of Criminal Procedure provides for further investigation and under the Code, there is no provision for re-investigation as prayed for by the petitioner in the present revisional application. Accordingly, the revisional application may be disposed of and order may be passed accordingly. In view of the facts and circumstances of the case and that there is no provision for re-investigation under the Code, the order passed by the learned Chief Judicial Magistrate in GR Case No. 173 of 2009 is set aside. The revisional application, being C.R.R. No. 151 of 2011, is, thus, disposed of.
Let a copy of this order be sent to the learned court below for information.
