In view of the above, this Court is inclined to hold that allowing the proceeding to continue shall be a futile exercise. The proceedings being GR case no. 2729 of 2023 pending before the learned Chief Judicial Magistrate, Barasat, presently transferred to the learned Judicial Magistrate, 2nd Court, Barasat, be quashed. The private opposite parties be set at liberty at once and discharged from their bail bonds.

CRR 328 of 2025 is disposed of.
