Learned advocate appearing for the petitioner submits that the petitioner is aged about 78 years and is in custody for 2 years 8 months 25 days. It has also been submitted that out of 28 witnesses cited by the prosecution, till date only one witness has been examined.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the orders passed and from where it is reflected that although witnesses were repeatedly present, but on absence of participation of the defence/accused, the trial of the case could not proceed.

Having considered that the accused has adopted a dilatory tactics to stretch the trial and take benefit of the

same, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 232 of 2026, is, thus, dismissed.
