Learned advocate appearing for the petitioner submits that the petitioner is in custody for about six months and chargesheet has already been submitted. Learned advocate raises issue in respect of the manner of seizure as well as the way in which the investigation has been carried out in gross violation of provisions of law.

Learned advocate for the State submits that in the present case from all the accused persons as a whole 121 kgs. of ganja were recovered. It has also been submitted that the court is at the stage of consideration of charge or there is every possibility that charges have been framed by the learned special court. Earlier, the prayer for bail of the petitioner was rejected.

Having considered the stage of the case, I am of the opinion that the petitioner be well advised to approach this Court after the evidence of seizure list witness is over. At this stage, CRM(NDPS)165 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
