Jharucharan Pal versus The State of West Bengal & Ors.
Mr. Gobinda Chandra Baidya, Mr. Tushar Sil, Mr. P. Mondal, Mr. Tanbir Mandal ... For the Petitioner.
Mr. Vimal Kumar Shahi, AGP ... For the State.
Report submitted by the learned advocate appearing for the State be kept with the record. The petitioner complains that he and his wife being the parents of the respondent no.5 have been thrown out by the respondent nos. 5 and 6 who are son and daughter-in-law.
State has submitted a report which reflects that respondent nos. 5 and 6 have submitted that they do not have any problem, if the petitioner and his wife stay in their residence. On the other hand, the petitioner has imposed certain conditions which are not acceptable to the police authorities. Be that as it may, if the petitioner with his wife enter their residence and are resisted, the police authorities would provide proper escort so that they can enter their residence smoothly. For a period of fortnight, a lady constable every alternate day would visit the residence of the petitioner and would ensure that there is no untoward incident takes place. If there is any untoward incident which takes place, the police
authorities would take steps in accordance with law.
In the meantime, the petitioner would approach before the appropriate authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. If any order is passed by the said authority, the police authorities would implement the same.
With the aforesaid observations, the writ petition being WPA 1734 of 2025 is disposed of. There will be no order as to costs.
