Ms. Salma Sultana Shah, Mr. Sani Hossain, Mr. Miraj Hossain ...for the Petitioner Ms. Munmun Ganguly, Mr. S M Samim Ullah ...for the State The grievance of the petitioner is that respondent no. 24-02-2026 AKG Ct. 15 7 has constructed two shop rooms on Plot No. 2178, J.L. No. 102, Mouza - Furfura, P.S. - Jangipara, District - Hooghly. The petitioner claims ownership of the adjacent land. It is submitted that respondent no. 7, without obtaining any permission from the Panchayat Authority, has carried out the construction of the said two shop rooms. It is further alleged that the land in question is classified as "Doba,"

and without converting the classification to "Bastu," respondent no. 7 has constructed the shop rooms for commercial purposes.

It appears that the petitioner submitted a representation to the Pradhan, Furfura Gram Panchayat, on November 20, 2025, regarding the ongoing unauthorized construction. Learned counsel appearing for the petitioner submits that, notwithstanding the said representation, respondent no. 7 has completed the construction of the two shop rooms during the pendency of this writ petition.

Despite being served, respondent no. 7 has not appeared or been represented in these proceedings. In view of the above, this writ petition is disposed of with a direction to the Pradhan, Furfura Gram Panchayat, respondent no.

6, to consider the petitioner's representation dated November 20, 2025, within a period of two weeks from the date of communication of this order. If the Pradhan, Furfura Gram Panchayat, finds any unauthorized construction as alleged by the petitioner, appropriate action shall be taken in accordance with Section 23(5) of the West Bengal Panchayat Act, 1973. Accordingly, WPA 1644 of 2026 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
