This writ petition has been filed against nonconsideration and sitting over the representation of the petitioner dated 22nd November 2016 being Annexure - P7 to the writ petition made before the District Inspector of Schools (SE), Purulia/respondent no. 4 making claim of higher scale of pay in respect of Post Graduate qualification.

Considering the submission of the parties, this writ petition is disposed of by directing respondent no. 4 to consider and dispose of the aforesaid representation being Annexure - P7 to the writ petition within eight weeks from the date of communication of this order, in accordance with law and by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioner or his authorized representative and communicate its decision to the petitioner within two weeks thereafter. Liberty is granted to the petitioner to take all points before the authority, which have been raised in this writ petition and the respondent no. 4 shall consider the same including the judgment of this Court passed in Partha Sarathi Das vs. The State,

reported in 2014(4) CHN (Cal) 261 and an unreported judgment passed in W.P. 29941(W) of 2014 (Prasanta Kumar Majhi vs. The State of West Bengal & Ors.) on 23rd July 2015.

WPA 184 of 2018 is disposed of.

Since the writ petition is disposed of without inviting the affidavits from the respondents, the allegations contained therein shall not be deemed to have been admitted.
