Learned counsel for respondent no. 3 submits that, in order to effectuate such a connection, a pole must be installed on a plot of land owned by respondent no. 3.

The petitioner, however, disputes this assertion, claiming that the relevant land is owned by him. Learned counsel for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that, in light of the dispute between the petitioner and respondent no. 3, the matter has been referred to the concerned District Magistrate in accordance with Rule 3(b) of the Works of Licensees Rules, 2006, by a letter dated January 30, 2025.

Let the letter dated January 30, 2025, be kept with the records.

In view of the above, this writ petition is disposed of with a direction to the District Magistrate to decide the matter after providing an opportunity for hearing to the petitioner, respondent no. 3, and the representatives of WBSEDCL. The District Magistrate shall issue a reasoned order within two months from the date of communication of this order.

Accordingly, WPA 1753 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
