The petitioner is in custody for 5 years and 9 months. Learned counsel for the petitioner submits that there has been no progress in trial and the petitioner is languishing in custody though his detention is no longer required. Learned counsel for the State produces the case diary and opposes the prayer.
The allegation against the petitioner is that the petitioner has murdered his three months old child. Out of 15 charge sheeted witnesses 6 witnesses have been examined.
Considering the material available in the case diary and the gravity of the offence, this Court is not inclined to favour the petitioner with an order of bail at this stage. Accordingly, the prayer for bail is rejected. However, the learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as
possible without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail, being CRM (DB) 345 of 2025, is, thus, disposed of.
