It appears that the Pradhan, Dhatrigram Gram Panchayat intimated the Block Development Officer, Kalna-I Development Block that the grievance of the petitioner was incorrect and false. The allegation that the panchayat authorities were installing a water pipeline through the land over which the petitioner claims title was found to be incorrect.

As per the contention of the gram panchayat and on the report of the Block Development Officer, Kalna-I Development Block, the stand of both the authorities are clear. The alleged land of the petitioner was not being utilized for installation of any water pipeline.

The report of the police authorities indicates that a water pipeline had been installed excluding the disputed land. Such pipeline was installed to

provide adequate water supply to the persons in the locality.

Under such circumstances, no further order is necessary. The authorities shall not utilize the land of the petitioner, except in accordance with law. If there are private disputes between the petitioner and other parties with regard to the claim over the land etc. the petitioner will be at liberty to approach the appropriate civil court for necessary orders. This order shall not be treated as a declaration of title of the petitioner in respect of the land in question.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
