Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's 82 years old mother was suffering from liver cancer. She committed suicide by hanging. The local people took this opportunity to pressurize the petitioner to convey his property to them. When the petitioner objected, the private respondents started a social boycott of the petitioner's family. Thereafter on several occasions, they attacked the petitioner's house and assaulted the inmates. Only after filing the present writ petition, an FIR was registered. By an order dated 20.12.2023 passed in 28250 of 2023, this Court directed that the police shall post a picket of two police personnel,
one of whom should be armed in front of the petitioner's house and the same shall continue for a period of two months from such date. In spite of this, the local people continued to disturb the petitioner. In fact, they have started to make an illegal construction on a portion of the petitioner's land and trying to encroach upon the same. Learned counsel appearing on behalf of the State relies on the report and submits as follows. Earlier, an FIR had been registered which is being investigated. On the direction of this Court, a police picket has been placed. Incidentally, the petitioner has also filed a civil suit in respect of his land. It appears that the police have complied with the order by this Court in placing of a police picket of two police personnel in front of the petitioner's house. However, the same would be of no use if they remain as mute-spectators when the petitioner's life or property is attacked. Therefore, the police personnel shall ensure that the petitioners life and property are protected.
In the event any cognizable offence is committed by the miscreants and the petitioner lodges complaint in this regard, necessary action shall be taken by the police authorities by registering an FIR and investigating such cases.
Even otherwise, the police shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. The police picket directed earlier and placed by the local police authorities in front of the petitioner's house shall
continue for a further period of three months from this date. With these observations, the writ petition is disposed of.
