July 17, 2025 7 ARDR CRM (DB) 323 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, filed in connection with Raghunathganj Police Station Case No. 998 of 2024 dated 14/8/2024 under Sections 85/80(2) of the BNS, 2023 and Section 4 of Dowry Prohibition Act.

And In Re :

Prabir Das @ Utpal Das ... Petitioner.

Adv. Shounak Mondal, ... for the petitioner.

Adv. Rana Mukherjee, Adv. Srilekha Chatterjee, ...for the State.

At the outset, it is recorded that the mother-in-law of the victim has not surrendered before the learned trial Court till date. Bail petition is taken up for consideration.

Learned counsel for the petitioner submits that the petitioner is in custody for more than three hundred days. Charge sheet has been submitted. Co-accused is on bail. His further detention is not required.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner is the husband of the hapless victim who committed suicide within one and half years of her marriage. Independent witnesses have implicated the petitioner. Charges have been framed. The witnesses are yet to be examined. In the event the petitioner is released on bail at this stage, likelihood of his winning over the witnesses or intimidating them cannot be ruled out.

Considering the material on record, prayer for bail is rejected at this stage.

The application for bail is disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
