Learned Advocate appearing for the petitioners submits that the petitioners are in custody for about four months and the quantum of seizure is 21.5 kilograms of ganja.

On the other hand, Mr. Ganguly submits that 22.1 kilograms of ganja were recovered from the possession of the petitioners, but so far the detention is concerned, learned advocate submits that the petitioners are in custody for almost four months and till date charge sheet has not been submitted.

Having considered the fact that charge sheet has not yet been submitted, I am not inclined to grant bail to the petitioner nos.2 and 3, namely, Mirjamal Sk. and Abdul Mannan respectively.

Their prayer for bail is rejected.

So far as the petitioner no.1, namely, Konika Mondal is concerned, she happens to be a lady. Accordingly, her prayer for bail is allowed.

Accordingly, the petitioner no.1 viz, Konika Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/-, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act at Berhampore, Murshidabad.

If on bail, the petitioner no.1 shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court.

The application for bail, being CRM (NDPS) 166 of 2026 is, thus, partly allowed.
